General Terms and Conditions (GTC)
1. Scope of application
Reto Baumgartner operates under the name “RB Baumgartner” an internet site offering the purchase of watches. The following General Terms and Conditions (GTC) regulate the contractual relationship in the version that is valid upon conclusion of the contract between Reto Baumgartner (hereinafter referred to as we) and customers (hereinafter referred to as you) who obtain goods and services via this webshop.
2. Offer
The offers that we make on the website are non-binding. They apply only as long as a product is available. We reserve the right to make changes to prices and to the product range. The products are described to the best of our knowledge and belief. Small deviations in size, colour, structure and processing are possible.
3. Order and conclusion of contract
With an email order or, in the case of a telephone order, with the oral transmission of the order data, you submit a legally binding offer to conclude a purchase agreement and accept the present General Terms and Conditions and the prices indicated. You will receive from us a confirmation of the order received. This order does not represent an acceptance of the offer by us. The legally binding contract comes about only with the dispatch of the order confirmation via email.
4. Prices
The prices are shown in Swiss Francs (CHF) without shipping costs. The shipping costs are calculated separately. The prices include an 7,7% Value Added Tax (MWST-No. CHE-301.693.499).
5. Payment
Payment is only possible using payment methods that are accepted on the internet page. These are at the moment as follows:
- Cash payment upon collection
- Payment in advance within 5 working days (if no payment is made within 30 days after the order is received, the order will be annulled)
- Paypal
6. Delivery and delays
We currently deliver in Switzerland and in the Principality of Liechtenstein. Delivery will take place from Münchenbuchsee. Dispatch generally takes place within 5 working days upon completion of the watch. You will be informed of the period of time that may be required to produce the watch by us via email. General exceptions will be indicated on the website.
The delivery will be sent via the Schweizerische Post (A-Post (priority post), registered mail)). The watch can also be picked up in Münchenbuchsee or in the local shop in Aarberg.
We shall not be liable for any delivery delays which are due to manufacturing companies, producers, third parties or force majeure. In the event of delivery delays of more than one month, you will have the right to withdraw from the contract without prior notice.
If the delivery is not accepted by you or is collected and is then sent back to us, we shall invoice you for the complete transportation costs and the additional costs accrued.
7. Shipping costs
The shipping costs (packaging and transport) are:
Up to 2 kg CHF 15.00
Up to 5 kg CHF 17.00
Up to 10 kg CHF 20.—
Bulky packages and packages above 10 kg Charged according to expense
8. Right of return
You can send goods that have been ordered back to us within 7 working days from the date of shipping at your own expense and risk. Items that have already been used are excluded from this. The goods must be undamaged, complete and in their original packaging. Additionally, the reason for return must be specified. If these criteria have been fulfilled, you will receive the purchase price less the shipping costs in accordance with section 7 as a refund. If the return criteria have not been fulfilled, then we have the right to refuse the return.
All watches that have been personalised with your name are explicitly excluded from this right of return. In this case, the return procedure must be defined individually between the seller and the buyer.
9. Warranty
Please immediately check the delivered goods and report any defects immediately via email, or at the latest 5 days after receipt of the goods. The defective good must be returned to us within 10 days after receipt. The shipping costs will be assumed by us. The claim for warranty shall expire for reports or returned goods that do not arrive in time.
A warranty of 2 years is granted for new watches. Excluded from this are the following:
- Normal wear due to wearing and the aging process (e.g. scratched glass etc.)
- All damage of watch parts that can be traced back to improper handling, lack of care and improper use of the watch
- Repairs of other watch brands.
10. Final provisions
The General Terms and Conditions and the contracts which are concluded based on these General Terms and Conditions are subject to Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Bern. We reserve the right to be able to change the General Terms and Conditions at any time. The currently applicable version will be published on our website and shall apply from the point in time of publishing.
In the event that individual provisions of these General Terms and conditions or parts thereof should become ineffective, this shall not affect the validity of the remaining provision.
